LEADERSHIP EFFECTIVENESS TRAINING: 8 sessions, certificate program. Learn the essential skills for being an effective union leader. Topics will include leadership roles and responsibilities, responding to anti-union comments, dealing with conflict and difficult people, communication skills for talking to management and members in crisis, and strengthening your membership. Instructor: A. Valdez.

INVESTIGATING DISCRIMINATION COMPLAINTS: 3 sessions. It is important to have sufficient training in order to deal with workplace discrimination and harassment. This course will provide an in-depth understanding of all forms of discrimination and hands on practice in learning the basics of complaint investigation. 3 sessions. Instructor: A. Valdez.

PARLIAMENTARY PROCEDURE: 5 sessions. This is a leadership program designed for union members, officers and staff, particularly chairpersons, secretaries and treasurers. Learn how to properly and lawfully conduct and record business in union meetings. Based on the 10th ed. of Robert's Rules of Order Newly Revised. Topics to include quorum, agenda and order of business; progress of main motions, precedence of motions, elections & voting, minutes; conventions and resolution writing. Instructor: W. UNION REPRESENTATION: LEGAL DUTIES & RESPONSIBILITIES: 3 sessions. A review of issues related to the duty of fair representation, the "Bill of Rights" for union members and other requirements of State and federal labor laws. Instructor: W. Puette, Ph.D.

RECESSION, FINANCIAL CRISIS, UNEMPLOYMENT AND LIVING STANDARDS: 4 sessions. An introduction to aspects of the economy of vital interest to labor, including the background of the Global, U.S. and Hawaiian economic crises: who was responsible and the framework for assessing short and long run solutions. Topics include banks and the shadow banking system, regulation, income distribution, unemployment, state budgets unemployment and inflation, the standards of living and the vital role that labor plays in the economy. DISCIPLINARY GRIEVANCES & JUST CAUSE: 3 sessions. Review the essential elements arbitrators require of an employer to prove its case against an employee and what procedural rights employees have when faced with such charges. Topics include: Weingarten Rights, Due Process, At-Will Employment, constructive discharge, and "the 7 Tests of Just Cause". Instructor: W. Puette, Ph.D.

PREPARATION FOR BARGAINING IN HARD TIMES: 4 sessions. How to measure "real" wages, calculate ability to pay, and the actual "cost" and value of employer & union proposals for both public and private sector collective bargaining. Students are expected to bring their contracts and problems to class. Instructor: L. Boyd, Ph.D.

RIGHTS ARBITRATION: 6 sessions. Topics to include arbitrator selection, case presentation, evidence and proof, witness examination and cross-examination, etc. Participants will prepare and present a mock arbitration. Enrollment will be restricted to students who have already completed CLEAR's Grievance Handling series or possess equivalent experience. [minimum enrollment, 8; maximum enrollment, 20] Instructor: W. ULP's: 4 sessions. Learn how to recognize, document and write up "Unfair Labor Practices" under the National Labor Relations Act in three core contexts: Organizing, Bargaining, and Representation. Instructor: W. Puette, Ph.D.

To enroll in any of the CLEAR classes, you need to submit an enrollment form with payment to CLEAR as early as possible. Ten dollar ($10) late registration fee per class will be charged for enrollments received less than seven (7) days prior to first night of class. Fee payment (payable to: University of Hawaii) will be returned only if you withdraw 10 days prior to the first night of class or where the class is canceled.

It is important to register in advance. Classes not sufficiently enrolled one week prior to commencement will be canceled.

Two New CLEAR Services Available

Facilitation and Strategic Planning Retreats
CLEAR is now able to provide facilitation services for union meetings or meetings between the union and management where a neutral outside party is needed. There are times when it is difficult for union leaders to both conduct a meeting and fully participate in discussing the issue, especially when they are also one of the stakeholders. Using an outside facilitator enables leaders to fully participate. For the same reason it may also be useful in some situations to use an outside facilitator for certain meetings between the union and management.

If it is time for your union to do some serious long-range planning, assess your current objectives and define or refine your future goals, a strategic planning retreat may be the answer. Strategic planning is a proactive step designed to objectively assess and enhance the unions effectiveness as well as prepare for and hopefully sidestep crisis situations.

NON-CREDIT FEE POLICY

A. Individual/Student Enrollments in CLEAR Sponsored Programs:

1. Class/program enrollment fees for individuals wishing to attend CLEAR programs shall be set in advance at approximately the rate of between $10.00 and $25.00 per session or class and made payable by cash, or personal check for the entire scheduled program in advance to the "University of Hawaii."

2. Partial enrollments to multiple-session programs (i.e.. for one or more sessions less than the full program) shall not be permitted.

3. A canceled check or cash-receipt issued by the Center for Labor Education & Research shall serve as proof of registration in the program.

4. A full refund of program fees will only be made to individuals who notify CLEAR of intent to withdraw ten (10) days prior to the commencement of the program. There will be no partial refunds.

5. An applicable fee, used by the University of Hawai'i system, will be charged by the University of Hawai'i for each check not honored by the bank/financial institution for any cause.

B. Fees for CLEAR Presentations at Programs not sponsored by CLEAR:

1. Unions, government agencies and non-profit organizations sponsoring programs at which faculty of the Center for Labor Education & Research are invited to speak or present instructional workshops or seminars shall be charged $100.00 per hour or portion thereof (breaks included).

2. Unions, government agencies, and non-profit organizations sponsoring programs at which faculty of the Center for Labor Education & Research are invited to speak or present instructional workshops or seminars shall be charged $100.00 per CLEAR staff presentation of any duration less than one hour (breaks included).

3. Businesses and for-profit enterprises or corporations sponsoring programs at which faculty of the Center for Labor Education & Research are invited to speak or present instructional workshops or seminars shall be charged fees at competitive rates as negotiated with the director of the Center.

4. For distance education presentations an additional $5.00 will be charged for each participant viewing the presentation at a remote site.

5. Organizations sponsoring programs not on Oahu at which faculty of the Center for Labor Education & Research are invited to speak or present instructional workshops or seminars shall, in addition to the program fees described above, provide and/or pay for all necessary travel fares, accommodations and attendant expenses required.

C. Exemptions:

1. The above fees, with the exception of travel expenses as described in paragraph B-4, will not be applied to: 1. guest lectureships involving presentations made to students in primary or secondary schools; 2. guest lectureships presented to university or college students; or 3. presentations made for Boy Scouts, Girl Scouts or similar non-profit, youth organizations.

2. Individual enrollment fees, as prescribed in section A, may be waived by CLEAR's director for workers who are on strike, unemployed or otherwise suffering economic hardship.
